Whether the land was no-man's land, belonging to no country, on the moon, on mars or called never-neverland....it is currently occupied by a foreign power ergo Israel is termed the "Occupying Power" and the Geneva Convention applies. The Israelis can bend and twist the language as much as they like but the bottom line is they are in violation of article 49. The Convention applies to all signatories, no exceptions....not even for poor misunderstood Israel.
