Yup. The only real advantage of arbitration is speed. (Secondarily, privacy about the terms that are in the contracts.) It's not necessarily cheaper. and, as you point out, it has many disadvantages, including the one you mentioned. Of course, that has not prevented NOK from appealing an arbitration decision. I think the Vitelcom suit was arbitrated and NOK appealed the confirmation order.
