Don't forget GSM was invented even before L M Ericsson invented CDMA in 1890, so the GSM patents have expired long ago. Even CDMA patents are starting to expire.

Perhaps QUALCOMM has rights to Nokia patents through GSM Guild patent pooling and agreement with other licensees who have full rights to Nokia patents, so QCOM uses patent pool patents, which don't belong only to Nokia since they were pooled with back-scratching 6 Musketeers agreements.

In any event, Nokia will have to prove that QUALCOMM is in fact using Nokia's patents and not only that, but that royalties are due. Nokia on the other hand agrees that they are using QUALCOMM patents and that the royalty payments are due to QUALCOMM.
