Who got WHAT right?

Let's start at the top.

Nokia does not file an annual 10K with the US SEC. They never have since they started trading NOK shares as ADRs on the NYSE in 1994.

They do of course file an annual 20-F and their 2006 20-F was filed on March 26, 2007.

I excerpted all references pertinent to QUALCOMM v. Nokia and the expiring license agreement I found in that 20-F here ...

It is, of course, possible that I missed some references so feel free to attempt to find something in that document that remotely resembles the assertion that "they have stated in the 10k that it is more than 3%" in that SEC filing (or any other Nokia report or filing).
