Lawyers, too, have their own form of rear-view mirrors. It's called case law, when the The US Constitution alone doesn't suffice. What I have called the regulatorium, which is a term I first saw used by Bob Frankston, relates to the entire cabal made up of judges, regulators and legislators, all fitting squarely into the government side of the regime I described earlier as the "powers that be." Each of these bodies are necessary to maintain the rule of law. I grant you that without hesitation. But I'm not disputing that point. Rather, there is a need to eradicate, almost to a scorched-earth degree, many of the grossly outdated regulations and laws on the books that cause discussions and their ensuing decisions --concerning emerging areas of technology, especially as they affect the commons, to get bogged down in anachronistic minutia. This is, and I grant you this, as well, a lot easier said than done.
