I think its a credible arguement given the existance of the option that they aren't infringing until they have failed to pay per the agreement. That critical point will be reached in early September

As I said before, if Nokia had a royalty-free license that expired (with an option to extend), what would the critical date then be?

I would also note that in the last 2 years worth of discussions, Q's management has repeatedly talked about April 9th as the critical date. I know that they are now going to the arbitrator to say that Nokia has defacto elected to extend their agreement, but they are going to get a legal ruling before that is true. As of right now, Nokia is infringing.
