New to the board. I mailed my response with confirms and statements Monday. A little perplexed though. I asked for assistance from Scottrade where I still have shares in limbo. There response was as follows:

Scottrade is unable to provide any assistance on this matter since it is not a named party and thus not privy to the details of the lawsuit. If you have any questions or concerns with this matter, you may need to seek advise from an attorney.
Any account activity (such as statements or confirmations) made through your scottrade account can be obtained online.

Am I going to have to sue Scottrade?

I do see their name on the summons.
