He was a dictator. His party might have won a plurality of the vote, and he might have been appointed by Hindenburg, but once the Nazi's where in power they outlawed other parties, and didn't have any more free elections. Also Hitler's decisions where final, there was no way to vote him out, pass legislation overruling his decisions, or have the court declare his decisions void. In theory it could have happened, but in practice it was basically impossible and if it did happen it probably would have been ignored and the supporters of the action forcibly suppressed.
