In fact, you lose your right to free speech every day you go to a movie and aren't allowed to yell, "Fire!" in the crowded theatre. You see, rights aren't unfettered. They come with conditions, and are always balanced against other competing rights. The notion that any individual identified as a foreign enemy combatant deserves unfettered rights in this country is ludicrous.
