Well I'm not a lawyer (although I suppose the smiley meant that you were not asserting I was), so perhaps I won't go in to specific law as in general principles (which may or may not be embodied in law). I think too much effort is put in to holding third parties responsible. A drunk drive runs over your child, blame the bar, a murder is committed in your apartment, sue the owners of the apartment complex, or sue the gun manufacturer. A student downloads or rips a copyrighted song file and then makes it available for upload, sue the school...
