The delay in the ITC decision worries me. Why? Let me explain.

If the implications of any ITC decision were NOT far-reaching, I would be inclined to believe that the ITC would have already handed down a decision. In other words, the damages would be relatively limited and insubstantial, Qualcomm would pony up, Broadcom would either appeal or accept the decision, and things in the wireless industry would move along, business as usual. This has not happened. And this begs the question, why has it been so difficult for the ITC to decide on a remedy in this matter after a full and open public hearing?

With TWO DELAYS ALREADY in the offing, we may assume the ITC is going to make a decision that has consequences with teeth. The ITC, in other words, is worried about the broader implications of a stringent remedy, e.g., a full device ban or a chip ban or some combination of both. Contrary to how many longs feel about the consequences for Qualcomm, I am very worried about this. Because a remedy with teeth would really stick it to Qualcomm. And a remedy that strongly favors Broadcom would play right into Broadcom's hands. Because Broadcom holds an advantage over Qualcomm in Bluetooth devices and technology. And Broadcom would use this advantage to the hilt in an effort to gain market share away from Qualcomm in the U.S. wireless device market where Qualcomm is so strong.

So guys I have to tell you I am worried.Share your thoughts.

I hope the ITC delayed making a decision because the parties are close to a settlement. But if that is not the case, the alternative could be very austere for Qualcomm. And that would really hurt.

If the ITC ruled unfavorably, we would have to buy up more QCOM shares and get in on the cheap. And we would have to wait 18-24 months for this problem to work itself out in the market. Let's hope it isn't this bad.
