And they probably shouldn't. I don't see how state laws banning smoking violate the US constitution. Just because something is wrong and reduces freedom doesn't mean it violates the constitution, and if it doesn't violate the constitution there is no reason for the USSC to strike down the law.
Go move to China if you want the luxury of smoking wherever you want.
I don't want to smoke, I don't even want others to smoke, but if they want to its none of my business, and properly none of the government's to tell them otherwise, at least if they keep it contained to their own property, or the property of someone who's willing to allow it.
As for moving to China, that a very silly statement. China is much less free than the US, that doesn't mean its wrong to complain about infringements on freedom in the US.
