Yes that's probably a big part of the reason. No one wants to get sued.

Also once the trend starts (however it starts) it can gather some momentum because at least for a time you can have a "positive feed back loop" (positive feedback on a negative trend, I'm not saying its a good thing). People are less likely to get involved, so some body considering getting involved, feels weirder about the action, and also more exposed because if they get in trouble trying to help, they are less likely to be helped by the next person walking by.

Thinking about "walking by" that's part of it too. People are less likely to walk by, and more likely to zoom by in a car at 35 to 80 mph. In the car your more insulated from other people's problems, and you don't see them for as long either...
