When Libby lied he did not know there was no underlying crime. That is a key point of why perjury and obstruction are stand-alone crimes: You don't know what will be ultimately revealed when you choose to be less than truthful... It is a crime unto itself... The whole argument about "no underlying crime" is a red herring. And Berger cut a deal with GWB's justice department! I still can't figure out why they did that! He should have been prosecuted fully.
