No, DEC would not loose any $$ if they lost the case. The risk is that in the process of destroying INTC, they may destroy the entire Wintel bussiness, create uncertanty, and mess up their own future. If they are willing to settle by selling Alpha to INTC, then that was probably what they wanted from the start, Out of the CPU bussiness. After all, they are not very good at selling CPU's anyway.
