David, I wasn't aware that there was any appellant-type question about Vons/Safeway's counter suit. As is the usual practice in matters of this sort, counter suits are a way of life. I don't see any positive or negative news value - only surprise that jurisdiction was an issue in the first place. Let's face it, today's ruling gives no hint to the eventual disposition of the suit.
