Bush's domestic spying program is highly illegal. The SC did not rule on the legality of the domestic spying without warrants, it IS illegal and everyone knows that, only on the ACLU's technical ability to sue the NSA Bush-Cheney continue to be guilty as criminal traitors, in this case ignoring the Constitution to try and claim fascist-style imperial powers over ther American People.
