The family ought to consult local counsel.

If there have been other accidents on that road, the public entity could be responsible for the dangerous design, lack of warning, inadequate lights, etc.

I don't know the local practice in your state, but in most you have to file a claim with the public entity within a shorter time limit than the ordinary statute of limitations.
While the family might not be considering litigation at this moment, as time goes on, it might be something they'd consider and wouldn't want to have foreclosed.
