The BRCM offer of a free license to govt. and other agencies makes no sense, since these agencies would constitute only a small percentage of the market. Making handsets solely for this limited market would not make economic sense, and therefore, the proposal does not provide the remedy needed by equipment suppliers.

The fact that BRCM made an offer suggests that there is a real possibility the ITC action will be overturned, either by the President or by an appellate court. The case for BRCM is weak because there ARE other remedies, such as obtaining a court order to pay royalties. When there are other remedies that do not harm innocent bystanders, it is unlikely that the ITC ruling will stand.
