Don't need to. Just need to scare the defendants into settling. Even the court system encourages settlements, given that they can only bring 9% of the cases to trial.

It doesn't matter whether the defendant is a small business owner who's being sued by a shakedown artist (OMG, your bathroom mirror is 1/2 inch higher than allowable by law!), or a local government who can use taxpayer money to pay off anyone who plays the race card (look up Tennie Pierce on Google).
