That will only enter the discussion if it is somehow
alleged that Intel is selling below marginal cost.
And if yield is revealed, it will be redacted from the record.

But I'm not sure that will be part of the allegation.
The tech-mart smoking gun in Germany is not of that
type. My guess is that the case will be about exclusive
deals and possibly the allowable forms of volume
discounts.

Note that certain types of exclusive deals are considered
legitimate. For example, Coke can sign an exclusive
deal with McDonalds. Is an Intel exclusive with
Techmart worse than a Coke exclusive with McDonalds?
Not obvious.

I predict that the EU action will require Intel to play
nicer, but not involve any enormous fines. I think Intel's
practices were over the line, but not so egregious in
Europe that the EU will do much more than slap their
hand and make them promise to maintain certain practices
(non-exclusivity, uniform volume discounts) in their
future deals.
