Clearly not if he thinks that is legal. Ask 3M about the LePage decision. 3M did something similar to this, and lost.

And AMD's legal response was the correct one. If Sewell's quote is accurate, then Intel isn't using only "reasonable, stepped discounts". A reasonable, stepped discount is something like "quantity 10 $XXX, quantity 10000 $XX". Not "quantity 10% of your total business $XXX quantity 100% of your business $XX". The former is legal. The latter is not.

And this isn't merely my opinion. Again, ask 3M.
