Who writes all those ROE's? The lawyers or the generals? And who approves them?

When did we start making rules that are very tough to deal with in a heated battle, and when did we decide to make them so tough, we not only can't win, but we are wasting manpower, lives, as well as billions of dollars of weapons....?
