They certainly are at war with us. Consider the attacks, completed and attempted, AQ has made on us since Osama declared war on us in the mid-90's:

attacks on our military personnel in Saudi Arabia (Khobar & Riyadh)

blown up two US embassies - Tanzania, Kenya

attempted to blow up The Sullivans, a US warship (failed)

succeeded in blowing up the Cole, another US warship

attempted to blow up LA Intl Airport (failed)

flew a plane into the Pentagon (an attempt to destroy our central defense command)

attempted to fly a plane into the Capital Building or White House and decapitate our civilian government (failed due to the passengers of flight 93)

flew two planes into the WTC

planned followup attacks aimed at other cities (failed to federal response to the 911 attack)

Looking at that you see a very serious series of attacks aimed at both civilian and military targets. That some liberals say we should respond to this as a law enforcement problem is astounding. As if Al Qaida is a ring of car thieves or drug pushers or something.

Since 911 they've been either on the defensive (in Afghanistan) or on the offensive in Iraq where they say they intend to re-establish a new caliphate.

There is no logical way to look at this as anything but a war, though a different one than we've faced before.
