Sounds to me like this is not a first amendment issue. This is an issue of authors making silly decisions about which country they go to for their publishing. If they want to shop for a weak libel law, they should pick a US publisher. They contracted in England, and it's only their own ignorance of UK libel law that makes them now rue the deal.

This, imo, is an issue of caveat contractor, rather than a first amendment case- unless you want to extend the first amendment world wide (thus violating the sovereignty of other countries who might wish less open libel laws).
