Our systems are set up for that binary choice. I will write one post to you on this. If you don't "get it," forget it. We are not set up for a "binary choice." We are set up for a three way choice. Criminal, Combatant, Unlawful Combatant. It was obvious on 911 that these terrorists were unlawful combatants. So are the other ones we capture around the world. The "Unlawful combatant" clause was included in the Geneva convention from the start to handle PRECISELY these types of individuals. They are entitled to a military hearing to determine their status, and a firing squad if found to be these types of individuals. Anything else they get is a bonus. Our Left doesn't like this. They want them criminalized so that they can come under our court system. So people like Clark and Raustiala write double-talking Op-Eds to try to confuse the issue and get them off. It's that simple.
