They are entitled to a military hearing to determine their status, and a firing squad if found to be these types of individuals.

It's because we don't have an established infrastructure to deal with them. We don't have the infrastructure because they are not an historically-established, legitimate third paradigm. A mention in the Geneva Conventions does not an infrastructure create. It offers legitimacy to an alternative but not an infrastructure. It doesn't even give them a category label, just hints at it.

We need to either develop an infrastructure for them or fit them into one of the two existing paradigms.

Our Left doesn't like this. They want them criminalized so that they can come under our court system. So people like Clark and Raustiala write double-talking Op-Eds to try to confuse the issue and get them off.

Be that as it may, it doesn't change the fact that they don't fit into our traditional paradigms. We wouldn't be having all this legal and political squabbling if there were an established paradigm for "unlawful combatants."

It's that simple.

If not dealing with the disconnect by declaring it "that simple," works for you, you're entitled. But that doesn't make it so.
