They're terrorists and they don't deserve the protections for civilians or soldiers.

It's not about deserving protection in my mind. That may be what some bleeding hearts are hollering about but that's not my issue. It's about having established, recognized mechanisms for dealing with terrorists.

Take these guys with the pipe bombs. If it turns out that they are Islamist terrorists, are we going to send them to Guantanamo or the equivalent until the war is over? If they are Islamist terrorists, then they're illegal combatants, and that's the proposed disposition of illegal combatants. Before that, who is going to investigate and make that determination. The FBI? The military? The sheriff of Podunk? What are the lines of authority? Calling it murky would be too generous.
