have you tried the simplest solution - getting a new modem? The tech support people tend not to realize that a customer can run $1,000 worth of expenses on the help line when a $25 device can often solve the problem.

It happened to me with DSL. After about 100 to 200 man hours on my part - which can translate to 50 to 100 manhours on ISP side minus the hold time, it turned out to be bad DSL modem. My revenge was that the day Time Warner set up shop, I dropped DSL and switched to cable.

Cable worked flawlessly for maybe 4 years, when the service started to degrade visibly. I was able to cut to the chase with tech support (to level 3, who are able to authorize modem replacement). After a bit of fiddling, the tech guy authorized a modem replacement.
