I don't see how Qualcomm can bring a WCDMA suit before the Dec '08 option expires. On second thought, legal challenges may be possible after Nokia misses the first royalty payment in the upcoming quarter<i/>

Since the April 9th license expiration Nokia has been willfully infringing QCOM patents by continuing to sell WCDMA product without a valid license. Reason enough to bring out the big cannons IMHO although this action would clearly conflict with QCOM's arbitration request.
