It has never LEGALLY been established that QCOM is using NOK's IPR. I realize you don't believe this, but those are the facts. QCOM could have gotten access to NOK's patents from the TXN cross license. Prior agreements with NOK could have stated QCOM was "paid up" for NOK patents by agreeing to a lower royalty rate than the standard world rate. Anything is possible, we can only speculate. QCOM has stated QCT does not use NOK patents. The burden of proof is on NOK to prove QCOM does. We do however know for a fact that NOK is using QCOM's patents without a license.

The point is you are speculating QCOM is using NOK's patents for free and that is not a known fact at this point in time.
