Harold, you raise an interesting question, but the answer may be overshadowed by the issue of whether ANY Nokia WCDMA handset can work without using at least some QCOM patents. Nokia of course would try to narrow the argument to just GSM handsets, even if a GSM/WCDMA chip incorporated the IPR at issue. Nokia uses the same narrow approach to suggest to the European Commission that QUALCOMM is guilty of unfair business practices because it dominates one relatively small part of the wireless market, rather than the main issue of whether Nokia remains the dominant maker of wireless handsets.
