Have you ever bothered to calculate the royalty number using QTL's revenues and the ASP/unit numbers that Qualcomm provides each quarter?The number is far below 4.5%.

Yes. QCOM's third Qtr QTL revenues approximate 4% of 88 million devices sold at an ASP of $217.00 or $766 million as reported.
There are costs associated with QTL including but not limited to legal expenses. It appears by my numbers that your 3.5% is far below the actual rate paid to QCOM.
