This is something that keeps getting overlooked, and it drives me nuts. The FISA statute itself is suspended for, IIRC, 90 days following an act of war or Congress has acted, ie authorized the full extent of the President's war powers, making FISA moot.

The AUMF fully authorized the full exertion of the war powers, which includes espionage of all known and suspected foreign agents. FISA was only meant to apply to peacetime, Cold War espionage, not war.
