I think that animals, especially domestic animals, deserve human protection from undue suffering to the extent that they experience pain. The willful or wanton infliction of pain upon an animal by a human is indecent, offensive to humanity and civilization. It is base and brutal. We domesticated these animals to serve our needs and that generates a responsibility to not abuse them. That's our minimal responsibility to them.

As for basis, when an animals owned by A is abused by B, B is damaging A's property--as well as being a violent lowlife who doesn't deserve to be part of decent society. When an animal owned by A is abused by A, he's in breach of an implied contract--as well as being a violent lowlife who doesn't deserve to be part of decent society. Tack on the fact that animal abuse so easily escalates to humans.

Animals may not have rights but they sure aren't ordinary property.
