I guess I don't understand? If there is no sewer and the land won't perk, how can anyone build there at all? Because... the Township code also says that you can have density of more than 1 house/acre if the houses are on private sewer. Here, the developer proposed to put in its own private sewage treatment plant. Township neverthelss denied the plans. So the developer (and landowners) sued, saying the Township Code was being selectively enforced and was designed to artificially prohibit development.
