Ho Hum ...

L.,

<< EL - Ho hum.. Is this where you think it is at? Basically from now on Q will lose all legal actions regarding its IPR/patents? >>

I did not say that I thought that. I have specifically said, or implied, that in the 1st nine of their GSM infringement actions in progress against Nokia in 6 countries, I think that the issue of untimely declaration of essential patents to the SDO they declared them to is going to be a significant issue and may have a bearing on the outcome of each individual case -- but without negotiated settlement, due process could run for some time.

The San Diego decision, and Brewster's opinion, in an action that involves different patents and a different standards organization but is generically similar to the Nokia actions, was not QUALCOMM positive. It is of course subject to appeal.

We seem to be repetitively going over this ground again and again.

Some 13+ months ago, a week or so before you asked me if the "$20s [were] in sight?" and when QCOM closed at $38.17, you asked a similar question ...

Any extended answer to you today is going to be little different than how I responded to you back then ...

The horse may not be dead but I think we may be beating a very exhausted animal, and that your opinion or mine is not going to have any impact on an eventual outcome or QCOM share in the future.

<< I believe that the Q will work its way out of all this and that what happened re BRCM was an abberation and that firm steps have been taken to put the ship back on course. >>

I'm absolutely delighted to see that you are on the upside of your emotional roller coaster and that you are taking a positive view of recent events.

I don't think any individual that posts here believes that QUALCOMM's IP portfolio doesn't have considerable asset value, or that when all shakes out, and even if QUALCOMM doesn't restructure via a SpinCo, that QTL will continue to prosper and grow with ultra-high margin revenue flow. I don't. As a consequence, I remain QUALCOMM long, despite my own frustration with QCOM's share price performance over the last 3 years. I expected better. Fortunately the rest of my equity holdings have performed well in that period, and while QUALCOMM (not QCOM stock) has not performed well on the legal front the company has performed very well fundamentally.

Cheers,

- Eric -
