How can using a recorder in the open air be illegal wiretapping?

I bet when he gets to court they drop the charge. With all the filmed shots of police hitting people now, they are really sensitive on the subject.

These cell-phones now can all take pictures plus a limited amount of video. It's getting hard to get away with slamming a suspect around these days.
