I saw headlines about this when getting a quote for SUNW/JAVA over at Yahoo! yesterday. My read of the article for which you provide a URL is that SUNW started this by going after NTAP. As is usually the case, the party sued does their best to dig around and find something to countersue over. NTAP hit the jackpot (as far as they are concerned).

SUNW/JAVA sues over 3 patents and gets wacked by a seven patent infringement counterclaim. Great.

Network Appliance Inc. said it filed an intellectual-property suit against Sun Microsystems Inc., alleging the Santa Clara, Calif., software and computer-server firm violated seven patents. Network, a maker of data-storage equipment based in Sunnyvale, Calif., said the suit was in U.S. District Court in Lufkin, Texas. Chief Executive Dan Warmenhoven said Network is seeking a ruling on its patents and is also requesting a judgment to show it isn't violating three of Sun's patents in the U.S. A Sun representative couldn't be reached to comment.
