Beazer Homes said the notice's claims are false because the bonds don't require the company to file reports within a certain time period.

Gotta love the sheer bravado and chutzpah there.

It takes brass balls to go before the court and argue:

"Your Honor, under the terms of the indenture, we don't EVER have to file financials, but if we do, we are merely obligated to provide a copy to our bondholders within 15 days. So, in theory, we could go 15,000 years without filing financials, and we would still not have breached our covenants!"
