EX PARTE MOTION TO STRIKE EXHIBIT PURSUANT TO 11 U.S.C. § 107
Richard F. Clippard, United States Trustee, by counsel, moves this Court to strike Exhibit "9" of Document #213 filed with this Court pursuant to 11 U.S.C. § 107 of the Bankruptcy Code, and in support states as follows:
The United States Trustee filed his Witness and Exhibit List (doc. #213) in this case on the evening of September 14, 2007. Exhibit "9" included an individual Bankruptcy Petition from 2002 which included that individual's full Social Security Number. The undersigned counsel inadvertently filed the Exhibit before redacting the Social Security Number and apologizes to the Court for this oversight.
Although this Exhibit is a public record, the Court for cause, may protect individuals from the disclosure of a Social Security Number. 11 U.S.C. § 107(c).
WHEREFORE, the United States Trustee respectfully requests that this Court strike Exhibit "9" from Document #213 and allow the United States Trustee to substitute a new Exhibit with the Social Security Number redacted.
