I was thinking about this today as well, following Goldman's report. If Goldman were to pull an Enron with it's SPE's, would any auditor have the balls to call them on it? I think not, not unless they had a death wish...they could (and have?) paper it over indefinitely, with no repercussions to them.

And if they ever did get caught, a bail out would be automatic anyway......
