Dear xu: If it were a simple lawsuit SUNW vs MSFT I might agree the advantage is on MSFT's side. BUT, MSFT has made many enemies of late. Several attorney Generals of Big States like Calif. are investigating them, Ralph Nader has joined the fray and he is well known in his ability to energize and politicalize events, several other large companies like Netscape, Oracle and IBM have a strong interest in the outcome as well as many smaller companies. Put all this on SUNW's side of the scales and I think one must admit the scales are at least balanced now. If the FTC antitrust division raises its ugly head again in MSFT that could tip the scales to a quick settlement if MSFT has any brains, and I believe they do. I see this Gates as a fellow who pushes as hard as he can, as far as he can, until he meets stiff resistance then he stops and waits for the next opportunity. He would have to be insane, and I dont think that he is YET, to want to take on the whole world. JUST my thoughts. JDN

PS: Where in the world did this rumor of SUNW not meeting their projected earnings come from? Certainly not the company, they have had nothing but favorable things to say. I think they will at least meet if not beat the projections and I defy anyone to show me a company supported statement that says otherwise.
