mine lies flat. it is noisy during game play, but most games are also noisy, so not such a big deal. during movie playback (DVD), i found it unacceptably loud.

The fan noise is probably the worst thing about the 360, but I have to say that I dont remember noticing it the few times I have played DVD's. I just popped a DVD in and it seemed quieter than while gaming, but I think a regular DVD player would still be better. The thing that drives me nuts is when I pause a game and switch over to TV for a few minutes. At that point, the fan is ridiculously loud.

I also hate the fan noise on my Dell computer. The next time I buy a computer, a quiet fan might be the top requirement on my list.
