ORDER DIRECTING APPOINTMENT OF TRUSTEE
THIS CAUSE came to be heard on October 3, 2007, after notice, on the Motion of the United States Trustee for Appointment of a Chapter 11 Trustee, the Motion of John P. Murphy III Revocable Trust No 1, John P Murphy III, and Pro Plas LLC for Appointment of a Chapter 11 Trustee, upon the Objection filed by the Debtor thereto, and the Debtor’s Application for Authorization to Employ Arcadia Consulting Services to Provide William D. Bishop as a Chief Restructuring Office; after taking evidence and hearing the argument of Counsel, the Court
FINDS, for the reasons stated on the record in Open Court that “cause” is present to support appointment of a Chapter 11 Trustee, and CONCLUDES, also for the reasons stated on the record, that appointment of a Chapter 11 Trustee, instead of employment of a Chief Restructuring Officer, is the better course of action; therefore, it is hereby
ORDERED that the United States Trustee appoint a Chapter 11 Trustee in this case, and
it is further
ORDERED that the Debtor’s Application to Employ is overruled.
Pursuant to Local Rule 9022-1(c), the U.S. Trustee shall cause a copy of this Order to be served on each of the parties designated to receive this Order pursuant to Local Rule 9022-1(a) and shall file with the Court a Certificate of Service of the Order upon such parties within ten (10) days hereof.
