While I am not a big fan of securities lawyers, I am pretty sure that they did enough DD before commencing the lawsuit, to avoid the risk of being gagged by the company. Risk of libel is seemingly not existent at this point.

The fine print here is, at CFC that not the ESOP was the problem but rather that the option granting is ALLEGEDLY violating (not only state law but also) their own plan...!

CFC aint Apple and the company is in high regard only with vultures so it is a weak deer, as we say. Brocade was weak deer too... and when the street talks everybody listening up.
