Sometimes a company will do something and beg forgiveness later because they were able to do something very close to the line and get away with it previously.

Don't assume they didn't willingly do this with the expectation that they could call on past practices for defense. "It's always been marginally ok, and we can build a defense if called into question"

Also don't assume the legal climate will stay the same, there are alot of companies that are getting in trouble because they did something on the line of legal/illegal and the current legislative climate moved the fence post slightly one way or the other...
