Training is essential in my opinion. I've been trained to operate a lot of equipment myself. [I just refuse to go up too high on the booms and scissor lifts...lol]

I've already encountered the claim that instructions should be provided in Spanish and English. I've successfully argued that this was an employer responsibility not the responsibility of an equipment rental company that carries an inventory of equipment from many manufacturers. [Harder argument for manufacturers, but how many languages must they supply? In the end the employer must still ensure that its crew knows what they are doing.]

One of the questions we ask the plaintiff is whether he can read the newspaper in his own language. Often these folks don't even have enough education to do that, which is telling.
