One issue to consider when discussing the self insurance reserves is that the more successful Ames is in turning itself around, the more protracted any litigation may become.

When a company is in financial difficulties, litigants are incented to settle quickly while funds are still available. As Ames improves its financial situation, litigants are more apt to go after the deep pockets. I am not able to access the adequacy of Ames reserves specifically, but am suggesting that the amounts may be necessary.
