=DJ Rocker, Gradient Get 1 More Wk To File Answers,Counterclaims

Defendants in a libel case brought by online retailer Overstock.com (OSTK) have secured a one-week extension to file their answers to the company's claim that they colluded to depress its stock price.

Overstock sued Rocker Partners LLC, now renamed Copper River Management, and Gradient Analytics Inc. in Superior Court of the state of California in Marin County in August 2005, alleging that the short-selling fund and research firm engaged in unfair practices and conspired to produce negative reports to depress its stock price for profit.

Rocker and Gradient have denied wrongdoings, claiming that Overstock Chief Executive Patrick Byrne is attempting to silence critics. They both tried unsuccessfully to have the case dismissed and have now until Friday to file their answers.

As reported in an "In The Money" column last week, Rocker's legal filing will include counterclaims against Overstock, accusing the Salt Lake City online retailer of having orchestrated a short squeeze to boost its stock in violation of the California Corporations Code. The fund's allegations against Overstock will in part mirror claims it made in 2000 against now-bankrupt Belgian speech technology company Lernout & Hauspie. That suit is still ongoing.
